Terms of Service

By accessing or using QuantumByte (the "Service"), including all features, tools, and content, you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use the Service.

QuantumByte is an AI-powered no-code application development platform that allows users to build software applications through natural language prompts and visual tools. The Service includes features such as Agentic Chat, Canvas editor, and Advanced Editor modalities.

The Service is provided "AS IS" without warranty of any kind, express or implied.

• You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
• You agree to provide accurate, current, and complete information when creating an account.
• You are responsible for notifying QuantumByte immediately of any unauthorized access to your account.

Your Content: You retain ownership of the applications, data, and content ("User Content") you create through the Service.

License to QuantumByte: You grant QuantumByte a non-exclusive, worldwide, royalty-free license to:

• Host, store, and operate your User Content to provide the Service
• Use anonymized or aggregated data derived from your usage for product improvement, analytics, and service optimization
• Display your User Content within the Service for the purpose of allowing you to build, test, and deploy applications

Responsibility for User Content: You are solely responsible for:

• The legality and compliance of your applications and User Content
• Ensuring your applications comply with all applicable laws, regulations, and third-party rights
• Managing how your applications collect, use, and protect end-user data
• Obtaining appropriate permissions and licenses for any third-party content used in your applications

QuantumByte is not responsible for the content of applications you create or their compliance with data protection laws, intellectual property rights, or other regulations.

The Service uses artificial intelligence to assist in application development. AI generated suggestions, code, and content:

• May not be accurate, complete, or error-free
• Should be reviewed and tested by you before deployment
• Are provided to assist your development process, not as guaranteed solutions

You are responsible for testing, validating, and ensuring the appropriateness of all AI-generated output before using it in your applications. QuantumByte does not guarantee the accuracy, safety, or suitability of AI-generated content for any particular purpose.

You agree not to use the Service to:

• Create applications or content that is illegal, defamatory, obscene, or violates others' rights
• Engage in harassment, threats, or abuse
• Attempt to gain unauthorized access to the Service or other users' accounts or data
• Transmit malware, viruses, or harmful code
• Reverse-engineer, decompile, or attempt to derive the underlying source code of the Service
• Perform security testing or penetration testing without written permission
• Engage in any activity that disrupts or interferes with the Service
• Use the Service to process or store sensitive personal data without appropriate safeguards (including but not limited to biometric data, health information, or financial account information belonging to others)

QuantumByte reserves the right to investigate violations and may suspend or terminate your account for breaches of this section.

To the maximum extent permitted by law: QuantumByte is not liable for

• Loss of data, revenue, profits, or business opportunities
• Downtime, service interruptions, or unavailability
• Failures or inaccuracies in AI-generated content
• Loss or damage to applications or User Content
• Indirect, incidental, consequential, special, or punitive damages, even if advised of the possibility

Your sole remedy for any failure of the Service is reactivation of the Service or, if that is impossible, a refund of amounts paid for the period of the outage (on a pro-rata basis).

• QuantumByte does not guarantee uninterrupted or error-free access to the Service
• We may modify, suspend, or discontinue features with reasonable notice to active users
• We may perform maintenance that temporarily disrupts Service availability
• We do not provide a Service Level Agreement (SLA) or uptime guarantee

• Pricing is displayed at the time of purchase
• QuantumByte may change pricing for future billing periods with at least 30 days' notice
• Charges are billed to the payment method you provide
• You are responsible for providing accurate payment information
• Refunds for monthly subscriptions are not provided; however, you may cancel your subscription at any time, effective at the end of your current billing period
• QuantumByte reserves the right to change or discontinue a pricing tier or feature with 30 days' notice

QuantumByte may modify these Terms of Service at any time. Material changes will be communicated via email or a prominent notice in the Service. Your continued use of the Service after such changes constitutes acceptance of the updated terms.

By you: You may terminate your account at any time by deleting your account through account settings.

By QuantumByte: QuantumByte may terminate or suspend your account or access to the Service if:

• You violate these Terms of Service
• You engage in illegal activities or abuse
• Your account is dormant (no activity) for an extended period
• We are required to do so by law

Upon termination, you will lose access to your account and applications. QuantumByte is not obligated to retain or return User Content after termination, except as required by law.

The Service may integrate with or allow connections to third-party services (e.g., payment processors, APIs, hosting providers). Your use of such services is governed by their own terms and privacy policies. QuantumByte is not responsible for third-party services or their availability, security, or conduct.

The Service is provided "AS IS" and "AS AVAILABLE" without any warranties, express or implied, including but not limited to:

• Warranties of merchantability, fitness for a particular purpose, or non-infringement
• Warranties of accuracy, reliability, or completeness of AI-generated content or Service functionality
• Warranties that the Service will meet your requirements or be error-free
• Warranties of uptime, availability, or performance

You use the Service at your own risk.

You agree to indemnify, defend, and hold harmless QuantumByte, its owners, employees, and agents from any claims, damages, or costs (including reasonable legal fees) arising from:

• Your use of the Service
• Your violation of these Terms of Service
• Your applications and User Content
• Your violation of any law or third-party rights

These Terms of Service, together with the Privacy Policy, constitute the entire agreement between you and QuantumByte regarding your use of the Service and supersede any prior agreements.
